Overview

If you are planning to conduct certain categories of restricted research; planning to travel outside the United States for business or pleasure; ship materials to foreign countries; hire foreign nationals or conduct classes outside the U.S. you may be subject to a variety of federal regulations usually described under the general rubric "Export Control". UTEP's policies for complying with these regulations are contained in the Handbook of Operating Procedures, Sec IV Ch.9 v02.16.15., or click below.

SHIPPING OR CARRYING RESTRICTED DATA, SOFTWARE OR HARDWARE OUTSIDE THE U.S.

In most cases, Purchasing & General Services, can provide specific information or arrange for appropriate licenses if hardware is to be shipped. If carrying phones, laptops or tablets to a foreign location, contact Information Security Laptop/Desktop Encryption , for the most up to date information on restrictions that the country visited might enforce.

TRAVELING TO EMBARGOED COUNTRIES

The UTEP Travel Office maintains up to date information on countries to which travel is prohibited or due to instability, are on Department of State "Watch Lists".

PUBLISHING INFORMATION SUBJECT TO "EXPORT CONTROL" REGULATIONS

As a public university at which freedom of inquiry is a fundamental part of its mission nearly all of UTEP's research is ultimately in the public domain and therefore not subject to "Export Control" regulations unless specifically restricted be contact or other agreements. Researchers conducting research so restricted must complete a Technology Control Plan (TCP). For more information see the HOP Sec. IV Ch.9 v03.161.16 section 9.5 or contact the designated Office of Research & Sponsored Projects (ORSP) research project administrator.

EMPLOYING OR TRAINING FOREIGN NATIONALS ON RESTRICTED TOPICS OR IN FOREIGN LOCATIONS

Regulation governing the hiring of foreign nationals are complex and continuously changing. Human Resources should be contacted before offers are made for any form of employment of foreign nationals including faculty, staff, graduate assistants or post-doctoral fellows. ENTERING INTO AGREEMENTS WITH INTERNATIONAL ORGANIZATIONS OR PEOPLE

Agreements such as contracts, memorandums or understanding, or authorizations of personal services with international organizations or people must be reviewed and approved by either the Office of Research and Sponsored Projects (ORSP) or the Provost's Office depending on whether they involve sponsored research or are strictly academic. Researchers should contact their designated ORSP research project administrator. Individuals contemplating entering into strictly academic agreements should contact the Associate Provost responsible for compliance with export control procedures.
