International Shipping

The shipment of tangible objects, materials or other export-controlled items from the United States to a foreign national or foreign country could possibly require an export license from the federal government depending on the item, destination, recipient, and end use. 

Remember, everything that crosses the border is an export!

  • Even if it’s temporary
  • Even if it was not sold
  • Even if it will be used for research

When shipping tangible objects or materials for research purposes from the United States to an international destination, it is important to keep in mind that these items and materials must have an export control classification prior to shipment.  The exemption of fundamental research from export licensing requirements does not extend to the export of tangible objects and materials from the United States, regardless of the purpose of the export. International shipments of items and materials for research purposes should undergo the following four-step review:

1. Has a restricted party screening of the recipients of the tangible objects and/or materials been conducted?

When shipping internationally, it is important to check that the individuals or entities to which items or materials are being shipped are eligible to receive those materials (i.e. they do not appear on “specially designated national” or “restricted entity ” lists and are not in embargoed locations).  Please fill out the Export Control Activity Assessment form and submit to exportcontrol@utep.edu

2. Do you know the export classification for your shipment?

The Research Protections Program can assist with the classification of items and materials being shipped internationally. For commercial items, the manufacturer will often be able to provide you with the export classification for their product. For items or materials that have been generated here at UTEP, the Research Protections Program can assist with export classifications. Please email the Research Protections Program at exportcontrol@utep.edu for assistance.

3. Do you need an export license?

Shipments of objects and materials from the United States may at times be export controlled to their intended international destination. In these cases, the Research Protections Program will assist you in applying for an export license from the federal government. Shipment of export-controlled items and materials should ne planned well in advance, as it may take several weeks to several months to obtain the license from the relevant federal agency.

4. Do you need to file an Electronic Export Information (EEI) filing?

If your international shipment has a single item that is valued at more than $2,500, Electronic Export Information (EEI) filing is required. Please see the Export Control International Shipping Guidelines  on Electronic Export Information filing requirements.

Guidelines and Forms

Before shipping internationally, please complete International Shipment Request Form at least 10 days prior to shipment.  Completion of the form is required for ALL international shipments.

Please note that while the Office of Research Protections provides assistance for evaluating and/or filing export authorizations and related documents, we are not responsible for managing actual shipments (including completing U.S. Customs and Border Protection shipping documentation). Also, other export and import requirements may apply prior to shipping your items.

Effective September 27, 2020, the Bureau of Industry and Security (BIS) expanded EEL filing rules for shipments originating in the United States, with a destination of the People’s Republic of China (including Hong Kong), Russia, or Venezuela. An EEI filing is required for shipments to China, Russia, and Venezuela for:

  • All shipments of a single item or merchandise valued at more than $2,500, even of an export license is not required.
  • Shipments, regardless of value or content intended for military end-use.
  • Shipments of all ECCN items on the Commerce Control List, regardless of value or whether an export license is required to export the item, in order to obtain an ITN (Internal Transaction Number) prior to shipment. BIS regulations exclude documents and EAR99 items of less than $2,500 in value.

Contact the Office of Sponsored Projects to determine if a Material Transfer Agreement is required. An MTA covers the transfer of tangible research materials between two organizations and addresses issues such as allowable uses, transfer of rights, intellectual property rights, confidentiality, and liability.

Federal regulations require you to keep records of shipments for five years after the date of the shipment. These records include pro forma invoices, airway bills, export filings, and all associated communications.
