Controlled Thesis/Dissertation Submission Process

General 

Data subject to the   Export Administration Regulations (EAR)  International Traffic in Arms Regulations (ITAR),   U.S. Nuclear Regulatory Commission (NRC),   U.S. Department of Energy (DOE), and/or   Controlled Unclassified Information (CUI)  must meet specific federal security requirements and cannot be handled or stored in standard university systems. These security designations and requirements must be specially handled and cannot be submitted through normal UTEP Graduate School repositories.    

These procedures are applicable to theses and dissertations that were derived from or contain data that is designated as controlled by government regulation or proprietary to the source. Click HERE to complete the Theses\Dissertations Technology Control Plan.

Process

  • If a thesis or dissertation chair and/or graduate student recognizes or believes that the defense may include export-controlled material they must contact UTEP’s Export Control Office and Graduate School, as soon as practical and prior to the defense, in order to do the following:
    • Ascertain if the data being used is indeed export control restricted.
    • Seek approval from the Graduate School for an exception to forgo SafeAssign and ProQuest publication.
    • Notify the federal funding agency export control office.
    • Develop protocols to ensure the protection of the data during and after the defense.
  • Protocols will include the development of a specific technology control plan for the defense of the thesis or dissertation. 

  • Formatting
    Thesis and Dissertation Office formatting guidance must be done in person. Generally, controlled theses are limited to access by U.S. persons only. For guidance with formatting, please schedule a formatting consultation with the   UTEP Graduate School
  • Marking
    The document should be marked in accordance with the relevant regulations. Additional information on marking research documents, including theses\dissertations can be found  here  
  • Each page of a thesis designated   CUI    should include a banner/header with the following label: CUI//EXPT
  • General export control disclaimer on title page:    WARNING - This document contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et seq.) or the Export Administration Act of 1979, as amended (Title 50, U.S.C., App. 2401 et seq.). Violations of these export laws are subject to severe criminal penalties.
  • Submittal
    Controlled theses/dissertations   MUST NOT   be submitted to the Graduate School Research Repository. Contact    exportcontrol@utep.edu  with “Controlled thesis submittal” in the subject line and your contact information in the body of the message to request submission instructions.
  • Authentication
    Controlled theses are required to be securely stored until approval from the sponsor is received to publish the information. When sponsor approval is received, the document will go through the SafeAssign Check process for plagiarism analysis.

    • Contact the Graduate School if you are seeking an exception to the SafeAssign check and ProQuest publication.
  • PreVeil Secure System Archive
    Controlled theses must be stored in an encrypted and monitored environment. Requests to move controlled theses out of a compliant environment must be reviewed and approved by the Export Control Office.
